2007 LEGISLATIVE BILL TRACKING FOR ACCCI:
SPECIAL EDUCATION MEASURES:
Note:
There was no increase for special education in this year’s
budget.
HB 2251: special education; school year (Sen. L Gray).
Allows special education students to remain in school until
the end of the school year although they have reached 22
years of age. STATUS: Signed by Governor.
HB 2393: special education; surrogate parents (Rep.
Crandall). Changes responsibility for appointment of a
surrogate parent from the court to the Department of
Education. Requires appointment of a surrogate parent under
certain circumstances except when a foster parent meets IDEA
criteria to act as the parent for special education
purposes. STATUS: Signed by Governor.
CPS MEASURES:
SB 1306: CPS; confidential information (Sens. Rios,
Garcia, Landrum Taylor, Pesquiera, Aguirre, Arzberger,
Cheuvront, McCune Davis, Miranda, O’Halleran, Soltero).
Requires law enforcement agencies to ensure that they
protect the identity and safety of a person who reports
child abuse and neglect, as well as any other person who
could be endangered by release of CPS information. The law
enforcement agency is not required to disclose CPS
information if it would compromise the integrity of an
investigation. STATUS: Signed by Governor 4/16.
HB 2263: CPS; interviews; right to refuse (Reps. Groe,
Barto, Biggs, Burges, Clark, Kavanagh, McLain, Murphy,
Nelson, Nichols, Pearce, Yarbrough). Requires CPS
workers to inform a parent guardian or custodian under
investigation of their right not to allow the worker into
their home or to interview their child. More clearly
outlines the information that the CPS worker is required to
provide to the person under investigation, both verbally and
in writing. STATUS: Signed by Governor 4/11.
OTHER
MEDICAL/DENTAL MEASURES:
SB 1107: health
insurance; certain mandates excluded (Reps. Adams).
Changes the “Small Business Health Insurance Plans” to allow
certain health and disability insurers to issue individual
policies to small businesses exempt from statutory mandates
such as coverage for disabled major children, maternity
coverage of adoptive mothers, contraceptives, chiropractic
services, supplies, out-of-network occupational and physical
therapy services, certain non-formulary prescriptions,
medical supplies accessible to the consumer and more.
Redefines uninsured small business as a business with 2 to
50 employees who have been without health insurance for at
least six months. (As passed House). STATUS: This
measure was included in the budget.
Note: Preventative dental care for ALTCS adults was
included in the budget. There is an annual limit of $1,000
in expenses. The new Dental Director, Robert Birdwell, D.D.S.
with AHCCCS, is developing procedures to implement this new
benefit. The projected implementation date is October 1,
2007.
